Terms, Conditions,
and Policies: All terms, conditions,
and policies set out are subject to California law and are in accordance with
Visa, MasterCard, American Express, and Discover Merchant/Seller requirements
for online credit card transactions.
Customer
Information Security: PromMeUp
makes every effort to keep your online shopping experience fun and secure. Our
checkout process is protected by Thawte (a VeriSign® company) keeping your
information as secure as possible. PromMeUp also offers the ability to checkout
using Google Checkout®. PromMeUp will take no responsibility in case of
stolen customer information that is transmitted over the internet.
Payment
Methods: PromMeUp supports
credit card payments by using our secure online shopping cart or
through Google Checkout®. All four major credit cards logos (Visa,
MasterCard, American Express, & Discover) are proudly accepted by
PromMeUp. Your credit card will not be charged upon placing your order, rather
it will be processed by a sales representative through Bianca's Bridal, of whom
PromMeUp is a division of, after the availability of the purchased item is
confirmed. Note that on your credit card statement, the charge will be
described as “Bianca’s Bridal” as this is the mother company to PromMeUp. If
for any reason PromMeUp is unaware that the purchased item is unavailable at
the time of charging the credit card, PromMeUp will refund total payment
back onto that same credit card which was used to make the payment and
cancel the order.
Order Changes and
Cancellations: Once your order
is placed, you cannot change, alter, or cancel your order in any way unless
authorized by a PromMeUp supervisor. In the event an item in your order is not
available in stock or by special order you will be offered alternatives by
PromMeUp and the option to receive a full refund. PromMeUp reserves the right
to refuse any order placed through PromMeUp.com.
Product
Availability Disclosure: PromMeUp
has made efforts to display accurately the products featured on our site. In
the event that an item in your order is not available in stock for immediate
shipment, PromMeUp will automatically defer to placing a special order with the
manufacturer. PromMeUp is not responsible for errors made when the customer
selects a dress size and cannot guarantee a dress will fit. It is the sole
responsibility of the customer to use a tape measure to take one’s measurements
properly and then select the size that best fits them based on the respective
designers size chart. PromMeUp reserves the right to change the size charts at
any time. PromMeUp.com is not set up to display what is currently in
stock in our warehouse or the respective designers warehouse, please
use the "Contact Us" form to check on dress availability before
placing your order.
Changes to Site: We reserve the right to make changes to our
site without prior notice to you or any past customers.
Limitation of
Liability: PromMeUp does not
warrant that: 1) the contents of this site will be accurate, reliable or free
of error, 2) that this site or the server that makes it available are free of
viruses or other harmful components or, 3) that your use of this site will be
without interruption.
Privacy Policy: We respect your privacy. However, we do collect
customer information in an effort to improve the shopping experience. We
recognize we must maintain and use customer information responsibly and we
will never share or sell your information with a 3rd party.
Free Ground
Shipping: Our "Free Ground
Shipping" promotion applies only to addresses within the continental United
States of America.
Special
Orders: A special order is, but
not limited to; custom made items, made to order items, items that are not
available in our stock inventory and must be ordered from the respective
manufacturer/designer. Any single item valued over $500 USD is also classified
as a "special order" by PromMeUp. If the size/color/style ordered is
not available in our stock inventory, PromMeUp will automatically defer to
placing a special order with the respective designer only if the item can be
delivered to you by the prom/event date listed on your order.
Returns: If for any reason you are not completely satisfied
with your instock purchase you may return your merchandise for store credit
less the 20% restocking fee as well as the original shipping cost selected at
checkout. You must contact the PromMeUp Returns Department via returns@prommeup.com
within 3 days (business or non-business) of receiving your order for a return
authorization number. Our Returns Department operates 7 days a week and you
should expect an authorization within 1-2 days, if approved. Merchandise must
be postmarked within 3 business days of receiving a return authorization number
from us. Merchandise returned without authorization or returned late will be
refused or returned to the customer at the customer’s expense. Any upgraded
processing charges will not be returned in any form. All original tags must be
in place to receive credit for the return. All merchandise is carefully
inspected before accepted by our Returns Department. Any items returned to us
that appear to have been worn, washed, or altered in any way will not receive
credit in any form and will be returned back to the customer at the customers expense. Items
with snags, rips, make-up stains, odors (i.e. cigarette smoke, deodorant) or
other damages will result in the item being returned to the customer at the
customers expense. If "USA Ground + FREE" shipping method is
selected, an additional $20 USD will be deducted from total amount of credit
issued for approved return requests. All approved return requests will incur a
$15 USD Return Processing Fee, which will be deducted from total amount of
credit issued. The customer is solely responsible for return shipping
arrangement and cost back to our showroom in California. If for any reason
the customer refuses their shipment from PromMeUp, an additional fee of
$20 USD will be incurred. The entire Return Policy is subject to the
"Exceptions to Return Policy" section in this sales policy.
Exceptions to
Return Policy: Sale Item =
Final Sale. There are no returns, exchanges or cancellations on any sale
item or discounted merchandise (i.e. items with promotion code(s) applied). Special
Order = Final Sale. There are no returns, exchanges or
cancellations on any item that requires a special order. International
Order = Final Sale. There are no returns, exchanges or cancellations
on any item that is shipped to an address outside of the continental United
States.
Return
Authorization: In order to return a
dress purchased from PromMeUp you must NOT contact us via our showroom
telephone number. Simply e-mail our Returns Department at returns@prommeup.com
and we will respond with your return authorization code if it meets our
policies criteria mentioned in "Returns". Make sure to include the
order number you received upon checkout in the return request e-mail. A
return authorization will not be granted if requested after your wear/event
date.
Restocking Fee: There is a 20% restocking fee for each eligible
dress returned to PromMeUp.
Exchanges: While we return for store credit if item meets
return criteria, we do not exchange items. If you need to exchange for a
different item, for any reason, you will need to place a new order and your
original item must be processed as a return. In order to use store credit from
original item you must wait until we fully process your return and e-mail you
your unique store credit number.
Store Credit: Store credit will be issued to customer after
successfully completing the return process laid out in these terms and
conditions. Store credit will be valid one (1) year following original date of
purchase. After the cut off date of one (1) year, store credit will be null and
void and all funds will be lost per the customers expense. Store credit may not
be used for shipping charges, standard or upgraded shipping will have to be
paid for separately via credit card. Store credit serial numbers will only be
issued one (1) time via e-mail from returns@prommeup.com. Replacement serial
numbers, which may be needed for any reason, will not be issued in any form
from PromMeUp, it is the sole responsibility of the customer to save and retain
his/her unique serial number in order to use it for latter purchases from
PromMeUp.
Chargebacks and
Disputes: The PromMeUp Returns
Department will make an effort to do everything within their means, according
to this policy, to avoid the need for chargebacks or disputes. However, if for
any reason, a customer disputes an authorized charge with their credit card
company or bank, that customer will automatically incur a $50 charge and/or
reduction from the total amount of credit returned.
International
Policies: You may be subject to
import duties and taxes, which are levied once a shipment reaches your country.
Additional charges for customs clearance must be borne by you; we have no
control over these charges and cannot predict what they may be. Custom and
import duties are not included in our international shipping policy or flat
rate shipping policy. Customs policies vary widely from country to country; you
should contact your local customs office for further information before you
place your order. Additionally, when ordering from PromMeUp you are considered
the importer of record and must comply with all laws and regulations of the
country in which you are receiving the goods. PromMeUp reserves the right to
approve which countries it will ship to and in the event a country is not
approved, the buyer will receive a full refund if already charged. On
international shipments, delays may occur that are beyond our control caused by
such factors as weather, language barriers, duties, taxes, import restrictions
and custom services. If duties are not paid by on entry to destination country,
or the merchandise is refused, the product will be abandoned in the destination
country and the customer will be responsible for 100% of the product cost and
shipping. The customer will not receive any type of refund or credit for
abandoned products. Maggie Sottero products (including, but not limited to, the
Flirt Prom line) are not available for sale or shipment outside of the United
States.
PromMeUp and
Bianca’s Bridal: PromMeUp.com is a
division of Bianca’s Bridal who’s showroom is located in Modesto, California.
All references made in this agreement which state “PromMeUp” or “PromMeUp.com”
are all of or related to Bianca’s Bridal. PromMeUp And Bianca’s Bridal are
considered one and the same.
Other: If any of these terms of use is unlawful, void, or
for any reason unenforceable, then that term shall be deemed severable from the
other terms and shall not affect the validity and enforceability of any
remaining terms.
These terms of use
constitute the entire agreement between PromMeUp and you, whose name appears on
the credit card or Google Checkout® order, relating to the subject matter
herein. PromMeUp shall have the right to change or modify these terms of use at
any time.
By checking "I agree
with the online sales policy." it is equivalent to signing a binding
contract, governed by California law, between yourself and PromMeUp
